Terms of application by Applicants

1. Registration

(1) Any person wishing to apply for pupillage with one or more Pupillage Providers may register as an Applicant on the Client Web Site and OLPAS.

(2) Any Applicant registering with OLPAS will commit to membership of OLPAS on the terms and conditions of use of OLPAS displayed on the Client Web Site, and the Applicant accepts and agrees to the terms and conditions by registration with OLPAS.

(3) Upon registration with OLPAS each applicant shall have their own secure username and password for logging on to OLPAS, and shall be entitled to use OLPAS and the facilities therein.

(4) GTI Online Solutions shall not charge any Applicant for use of the Client Web Site or for their registration with or use of OLPAS.

2. Help Desk and On Line Support - 01491 828918

(1) GTI Online Solutions shall provide to each registered Applicant support facilities which the Applicant can access by way of on-line help, on-line f.a.q.’s and a premium rate telephone support line (separate to that used by Pupillage Providers) to a help desk in the event that the Applicant experiences a fault with the Client Web Site or OLPAS ("the Help Desk").

(2) GTI Online Solutions warrants that:

(a) The Help Desk shall be open from 09:00 to 17:30 hours from Monday to Friday inclusive;

(b) it will respond to all calls/e-mails raising faults with the Client Web Site or OLPAS within three (3) hours if its staff are not immediately available;

(c) notify by call or e-mail any technical solution or information by close of the working day following any notification of any fault.

3. Data Protection

GTI Online Solutions warrants that it will not disclose to any third party (save to the extent that any such disclosure is to an agent of the government of the United Kingdom and is required by law) any data as defined by section 1(1) of the Data Protection Act 1998 and which is related to the Applicant. In the case of any breach of this obligation, the right conferred upon the Applicant shall be directly enforceable against GTI Online Solutions.

4. Limitation of Liability

GTI Online Solutions’ liability to each Applicant is limited to any breach by GTI Online Solutions of paragraphs 1 to 3 of this Schedule 9. GTI Online Solutions shall not be responsible to any Applicant for any act, omission, or decision made by any Pupillage Provider or third party with respect to any Applicant’s application for pupillage with the Pupillage Provider.

5.Governing Law

These terms shall be governed by and construed solely and exclusively in accordance with the laws of England. Any and all disputes between the Applicant and GTI Online Solutions that cannot be settled by mutual agreement shall be resolved solely and exclusively by the Courts of England and Wales.
